1. ACCEPTANCE OF TERMS

By accessing or purchasing from www.nuvanestudio.com ("the Website"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, you must not use this Website.

2. ABOUT US

Nuvàne Studio is a premium handcrafted Chikankari apparel and lifestyle brand rooted in the artisanal heritage of Lucknow, India.

3. ELIGIBILITY

You must be at least 18 years of age (or the age of majority in your jurisdiction) to place an order. By using this Website, you confirm you meet this requirement. International customers are responsible for ensuring compliance with all laws applicable in their country.

4. PRODUCTS & DESCRIPTIONS

4.1 All products are handcrafted. Minor natural variations in embroidery, fabric texture, or colour are inherent characteristics of authentic artisanal work and are not defects.

4.2 Colours displayed on screen may vary slightly from the actual product due to monitor settings, photography, and lighting conditions. Such variations do not constitute a defect.

4.3 We reserve the right to limit quantities, discontinue products, or modify descriptions at any time without prior notice.

4.4 Prices are listed in Indian Rupees (INR). International customers may see prices in their local currency at checkout, subject to real-time exchange rates.

5. ORDERS & PAYMENT

5.1 Order Confirmation: Placing an order constitutes an offer to purchase. A binding contract is formed only upon our written email confirmation.

5.2 Payment: We accept payments via methods displayed at checkout. All transactions are processed securely.

5.3 Pricing Errors: In the event of a pricing error, we reserve the right to cancel the order and issue a full refund, with prompt notification to you.

5.4 GST (India): Prices are inclusive of applicable GST. A GST invoice will be provided upon request.

5.5 International Taxes & Duties: International customers are solely responsible for any import duties, customs fees, VAT, or local taxes levied by their country's authorities. Nuvàne Studio does not collect or remit foreign taxes unless legally required.

6. SHIPPING & DELIVERY

6.1 Order Processing: Orders are processed within 2–4 business days of payment confirmation.

6.2 Domestic Delivery (India): Estimated delivery is 3–7 business days from dispatch. These are estimates and not guaranteed timelines.

6.3 International Delivery: We currently ship to select international destinations. Timelines vary by destination and are estimates only. Nuvàne Studio is not liable for delays caused by customs clearance, local postal services, or force majeure events.

6.4 Tracking: Tracking information will be shared via email or mobile upon dispatch.

6.5 Incorrect Address: Customers are responsible for providing a correct and complete delivery address. Re-dispatch due to an incorrect address or refusal to accept delivery may incur additional charges.

6.6 Risk of Loss: Title and risk of loss pass to you upon handover to the shipping carrier.

7. RETURNS, EXCHANGES & REFUNDS

7A. INDIA — DOMESTIC POLICY

7A.1 No Returns — Size Exchange Only: We do not accept returns for refund on domestic orders. We offer a size exchange within 7 (seven) days of delivery, subject to the conditions below.

7A.2 Mandatory Unboxing Video: To be eligible for any exchange or claim, customers must record a clear, uninterrupted unboxing video at the time of opening the package. Claims submitted without an unboxing video will not be accepted.

7A.3 Eligibility Conditions for Exchange:

Item must be unused, unworn, unwashed, and unaltered.
All original tags must be intact and attached.
Item must be in original packaging.
Exchange request must be raised within 7 days of delivery.

7A.4 Non-Eligible Items: Items that are worn, washed, altered, stained, damaged after delivery, or missing original tags are not eligible for exchange.

7A.5 Damaged or Defective Items: If you receive a damaged or defective item, contact us at trynuvanestudio@gmail.com within 48 hours of delivery with your unboxing video as evidence. We will arrange a replacement or appropriate resolution at no additional cost.

7A.6 Colour Variations: Minor colour variations due to screen settings, photography, lighting, or the handcrafted nature of the product are not considered defects and are not grounds for exchange.

7A.7 Exchange Process: To initiate an exchange, email us at trynuvanestudio@gmail.com with your order number, reason for exchange, and unboxing video within the applicable window.

7B. EUROPEAN UNION — RIGHT OF WITHDRAWAL (COOLING-OFF PERIOD)

7B.1 14-Day Right of Withdrawal: Under EU consumer protection law (EU Directive 2011/83/EU and EU Directive 2023/2673), customers in the European Union have the right to withdraw from their purchase within 14 (fourteen) days of receiving the last item in their order, without giving any reason.

7B.2 How to Exercise: EU customers can exercise their right of withdrawal by contacting us at trynuvanestudio@gmail.com or by using the withdrawal function available in your order confirmation or account page. You will receive an automatic confirmation of your withdrawal request.

7B.3 Withdrawal Period: The 14-day period begins from the date the last item in your order is delivered. If the last day falls on a weekend or public holiday, the period extends to the next business day.

7B.4 Refund: Upon receipt and inspection of the returned item, we will process a refund to your original payment method within 14 days. Return shipping costs are borne by the customer unless the item is defective.

7B.5 Exemptions: Certain products may be exempt from the right of withdrawal under EU law (e.g., customised or made-to-order items). Please consult applicable EU regulations or seek legal advice for specific exemptions.

7B.6 Non-Compliance Consequences: Failure to provide the required withdrawal function may result in the withdrawal period being extended to 12 months and 14 days under EU Directive 2023/2673.

7C. UNITED KINGDOM — COOLING-OFF PERIOD

7C.1 14-Day Cooling-Off Period: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, customers in the United Kingdom have the right to cancel their order within 14 (fourteen) days of receiving the goods, without giving a reason.

7C.2 How to Exercise: UK customers may notify us of cancellation by emailing trynuvanestudio@gmail.com with their order details within the 14-day window.

7C.3 Refund: We will process a refund within 14 days of receiving the returned goods or evidence of return. Return shipping costs are the customer's responsibility unless the item is defective or misdescribed.

7C.4 Exemptions: Customised or made-to-order items may be exempt from the right to cancel. Please refer to applicable UK consumer regulations.

7D. UNITED STATES — RETURN POLICY

7D.1 No Statutory Federal Cooling-Off Period for Online Purchases: The United States does not have a federal law mandating a cooling-off period for online retail purchases (the FTC's 3-day cooling-off rule applies only to door-to-door sales).

7D.2 Our Policy for US Customers: US customers may request an exchange within 14 days of delivery, subject to the same eligibility conditions as Section 7A above, including the mandatory unboxing video requirement.

7D.3 Damaged or Defective Items: US customers must notify us within 48 hours of delivery with an unboxing video for any damaged or defective item claims.

7D.4 Return Shipping: Return shipping costs for US orders are the customer's responsibility unless the item is confirmed defective.

8. INTELLECTUAL PROPERTY

8.1 All content on this Website — including text, images, photographs, graphics, logos, product designs, and embroidery patterns — is the exclusive intellectual property of Nuvàne Studio / Sarthak Enterprises, protected under the Copyright Act, 1957 (India) and applicable international copyright treaties.

8.2 You may not reproduce, distribute, modify, or commercially exploit any content without our prior written consent.

8.3 The Nuvàne Studio name, logo, and brand identity are trademarks of Sarthak Enterprises. Unauthorised use is strictly prohibited.

9. PROHIBITED CONDUCT

You agree not to:

Use the Website for any unlawful purpose.
Engage in fraudulent transactions or provide false information.
Resell or commercially exploit products without written authorisation.
Use automated tools (bots, scrapers) to access or collect data from the Website.
Attempt to gain unauthorised access to any part of the Website or its systems.

10. PRIVACY & DATA PROTECTION

10.1 Your use of the Website is governed by our Privacy Policy available at www.nuvanestudio.com, incorporated into these Terms by reference.

10.2 We comply with the Digital Personal Data Protection Act, 2023 (DPDPA) of India.

10.3 For EU/EEA customers, we process personal data in accordance with the General Data Protection Regulation (GDPR) where applicable.

10.4 For UK customers, we comply with the UK GDPR and the Data Protection Act 2018 where applicable.

10.5 For California (USA) customers, we comply with the California Consumer Privacy Act (CCPA) where applicable.

11. LIMITATION OF LIABILITY

11.1 To the maximum extent permitted by applicable law, Nuvàne Studio / Sarthak Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or products.

11.2 Our total liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.

11.3 Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

12. DISCLAIMER OF WARRANTIES

The Website and products are provided "as is" and "as available." We make no warranties, express or implied, except as required by applicable law, including the Consumer Protection Act, 2019 of India.

13. CONSUMER RIGHTS (INDIA)

Nothing in these Terms limits or excludes your statutory rights as a consumer under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, or any other applicable Indian consumer protection legislation.

14. INTERNATIONAL COMPLIANCE

14.1 Customers outside India are responsible for compliance with their local laws regarding the import and use of our products.

14.2 We do not represent that the Website or products are appropriate or available in all jurisdictions.

14.3 International customers confirm compliance with applicable import/export laws of their country.

15. FORCE MAJEURE

Nuvàne Studio shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, strikes, supply chain disruptions, or internet outages.

16. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Website after changes constitutes acceptance of the revised Terms.

17. GOVERNING LAW & DISPUTE RESOLUTION

17.1 These Terms are governed by the laws of the Republic of India.

17.2 Disputes shall first be attempted to be resolved through good-faith negotiation.

17.3 If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Lucknow, Uttar Pradesh, India.

17.4 For international customers, while Indian law governs these Terms, mandatory consumer protection laws of your home country (including EU, UK, and US consumer rights) may also apply and are not excluded by these Terms.

18. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Nuvàne Studio regarding your use of the Website.
